Justice Amadu Tanko was among five Supreme Court Justices that voted unanimously to dismiss an injunction application from suspended Chief Justice Gertrude Torkornoo against processes for her removal.
She aimed to stop the Gabriel Scott Pwamang Committee’s work. This committee is currently hearing three petitions for her removal.
On Wednesday, May 28, 2025, the five-member Supreme Court panel led by Acting Chief Justice Paul Baffoe-Bonnie and Justices Omoro Amadu Tanko, Yonny Kulendi, Henry Kwofie, and Richard Adjei Frimpong threw the injuction out.
In her affidavit, the suspended Chief Justice claimed inhumane treatment. She argued that this violated her dignity. She described the proceedings as a “mockery of justice” and a “ruse” to unjustly remove her.
The apex court ruled that her affidavit referred to events before the committee’s investigation. These proceedings are required by law to be held in camera.
Deputy Attorney General Justice Srem-Sai objected to the affidavit. He argued it violated Article 146(8) of the Constitution. This article mandates private proceedings for removing justices.
Justice Srem-Sai emphasized that disclosing committee deliberations breached constitutional requirements. Godfred Yeboah, former Attorney General and Torkornoo’s legal counsel, claimed the affidavit was submitted privately.
However, the Supreme Court found that the affidavit violated secrecy provisions under the Constitution. As a result, they dismissed the injunction application.
